Naturism in Vermont: The State Where Nudity Is Legal

Vermont is the quiet champion of American naturism: the only state in New England – and one of very few in the country – with no state law against simple public nudity. Being nude outdoors is not, by itself, illegal here. That legal quirk has produced both some of the Northeast’s best clothing-optional swimming and some of its strangest civic battles.

The Legal Framework

Vermont’s indecency statute (13 V.S.A. 2601) targets lewdness and intent to arouse or offend – following the state Supreme Court’s decision in State v. Brisson (1964), simple nudity in a non-coercive setting isn’t criminal. One genuinely Vermont-specific catch: undressing in public view is treated as disorderly conduct. You can be nude, but you should step behind a rock or into the trees to get that way. Towns can also adopt local ordinances, and a few have – for specific downtown areas.

Lake Willoughby: The Fjord Beach That Beat the Bureaucracy

In the state’s remote Northeast Kingdom, Lake Willoughby is a glacier-carved fjord of a lake, its south shore framed by the cliffs of Mount Pisgah and Mount Hor. Since the late 1960s, the secluded south beach has been a clothing-optional haven, reachable by an unmarked shoreline walk.

The tradition survived a genuine political siege. In 2007-2008, local petitioners pushed the town of Westmore to pass an anti-nudity ordinance – and the Selectboard declined, citing the estimated $25,000+ annual enforcement cost and jurisdictional headaches. When the state later proposed a million-dollar boardwalk, formal parking, and bathhouses at South Beach in 2017, naturists and privacy advocates pushed back and the project was scaled back. The quiet lesson: the tradition survived because it genuinely costs nothing to tolerate.

The Ledges: Southern Vermont’s Inland Classic

Near Wilmington, the rocky shoreline of the Harriman Reservoir – locally “Lake Whitingham” – hosts The Ledges, one of the premier inland clothing-optional swims in America, drawing 300-400 sunbathers on warm weekends. The land is privately owned by Great River Hydro (successor to the old hydro companies, managed under federal FERC license with public recreation requirements), and access runs from the Ward’s Beach area along a shoreline path. Local friction is real but narrow: it’s about parking and litter, not nudity itself, which remains legal under state law.

The Brattleboro Saga: Downtown Nudity, 2006-2008

No Vermont article is complete without the legendary Brattleboro episode. In 2006-2007, a group of teenagers and allies exploited the legal loophole – disrobing was illegal, but being nude wasn’t – by hanging out naked on Main Street. Under pressure from businesses, the Selectboard enacted a 30-day emergency ban in July 2007, then voted 3-2 against making it permanent in August. The result was national media coverage and a surge of street-nudity activism. In December 2007 the board reversed course, passing a permanent decency ordinance (4-1) for the downtown commercial zone, parking lots, parks, and areas near schools – with fines up to $500. Downtown Brattleboro is clothed; everywhere else in town, state law governs.

Visiting Vermont’s Naturist Lakes

  • Season: June through September; July-August water at Willoughby is bracing (it’s a deep glacial lake) and Harriman is famously swimmable.
  • Etiquette: Towel to sit, dress before entering the water at busy textile entrances, no photography, and keep to the traditional zones – the social compact is what keeps the legal tolerance intact.
  • Respect the no-disrobing rule: It sounds pedantic, but it’s the one ordinance that can actually be enforced against you.

Vermont pairs naturally with the East Coast’s one legally designated nude beach, Gunnison Beach in New Jersey, and our nationwide legal explainer on public-land nudity.
